1. Acceptance of Terms

By accessing and using Paddock Control ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Paddock Control provides a cloud-based platform for motorsport club management, including membership management, event organization, digital sign-on, and related features ("Service").

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account.

4. Subscription and Payment

4.1 Subscription Plans

Our Service is offered on a subscription basis. Pricing and plan details are available on our pricing page.

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis, or as otherwise agreed in your contract
• Payment is by invoice, settled via bank transfer within the payment terms stated on the invoice
• All fees are non-refundable except as required by law
• Prices may change with 30 days' notice to existing customers
• Failed or overdue payments may result in service suspension or termination

4.3 Cancellation

You may cancel your subscription by providing 30 days' written notice, or as otherwise specified in your contract. Cancellation takes effect at the end of the current billing period following the notice period. No refunds are provided for partial subscription periods.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations in your jurisdiction
• Infringe on intellectual property rights
• Transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service to send spam or unsolicited communications
• Impersonate others or provide false information
• Scrape or harvest data from the Service

6. Your Data and Content

6.1 Ownership

You retain all rights to the data and content you upload to the Service. By using the Service, you grant us a license to host, store, and process your data solely to provide the Service.

6.2 Data Responsibility

You are responsible for:

• The accuracy and legality of your data
• Obtaining necessary consents for member data
• Compliance with data protection laws (GDPR, etc.)
• Maintaining backups of important data

6.3 Data Export and Portability

You may export your data at any time in CSV format. Upon account cancellation, we retain your data for 30 days before permanent deletion.

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

8. Intellectual Property

The Service, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Termination

We may suspend or terminate your access to the Service:

• For violation of these Terms
• For non-payment
• If required by law
• At our discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. Provisions regarding data, liability, and indemnification survive termination.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDOCK CONTROL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Paddock Control from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
